Perhaps you had the time of your life riding on a friend’s all-terrain vehicle (ATV) in the summer, and now an ATV of your very own is at the top of your Christmas list. Be careful what you wish for, though. ATVs are harmless fun when everything is going well, but so much can go wrong with a vehicle that travels as fast as a golf cart but offers little more protection in terms of vehicle structure than a tricycle. An ATV is a three-wheeled contraption, low to the ground, that can go about 30 miles per hour if you really put the pedal to the metal. They are designed for off-road excursions in ATV parks or on public, undeveloped land, but in Louisiana, it is also legal to drive them on public roads with low-speed limits. Many of the recent ATV accidents that have claimed the lives of young people in Louisiana in recent years have involved ATVs driving on roads open to vehicular traffic and colliding with bigger motor vehicles that can go faster than an ATV. The Makings of a Horrific ATV Accident
On October 23, Alec Pelas was driving his ATV in the southbound lanes of Louisiana 23 in Plaquemines Parish. At around 1:15 p.m., his ATV drifted across the center lane into the southbound lanes, where it struck a GMC head-on. The driver of the GMC was not injured, but Pelas suffered critical injuries and remained hospitalized until his death on November 3. He was 22 years old.
The collision had all the makings of a disastrous accident. Head-on collisions are always bad news, even if both drivers are wearing seatbelts and are in cars equipped with the maximum safety features. A driver who has crossed the center lane into oncoming traffic is probably in no shape to avoid a collision, and the approaching driver often has little room to get out of the way despite his or her efforts to avoid a crash. The fact that one of the vehicles was an SUV while the other was a truck only makes it worse.
Your Rights if You Get Injured in an ATV Accident
If you get injured in an ATV accident, you can recover compensation for your accident-related medical bills and perhaps other accident-related expenses by filing an insurance claim with the legally responsible parties. It is often possible to get the money you need without filing a lawsuit, but you also have the right to sue. The responsible party might be the driver of the ATV or of the other vehicle involved in the collision. It might also be the owner of the property where the collision took place if there were preventable unsafe conditions.
